1. Acceptance Of Terms

These Terms of Use govern your use of Pean's mobile app, Apple Watch experience, website, and related services. By using Pean, you agree to these Terms and to the Privacy Policy.

2. Eligibility And Accounts

You must use a valid account and keep your sign-in method lawful and under your control. You are responsible for activity that occurs through your account.

If you choose a nickname, upload an avatar, create groups, or share spots, you are responsible for making sure that information is accurate and does not violate the rights of others.

3. What Pean Provides

Pean helps you save private places, organize them by category, attach notes or photos, sync them across supported devices, and optionally share selected spots with trusted groups.

We may add, remove, or change features over time, including beta or experimental collaboration features.

4. Your Content

You keep ownership of the content you submit to Pean, including spot notes, photos, profile content, and group names.

You grant Pean a limited license to host, process, store, copy, and transmit that content only as needed to operate, secure, and improve the service for you.

5. Acceptable Use

• Do not upload unlawful, infringing, abusive, or harmful content.
• Do not attempt to access another user's private spots, account, or groups without authorization.
• Do not reverse engineer, interfere with, overload, or disrupt the service.
• Do not use Pean in a way that violates applicable law or the rights of other people.

6. Privacy And Sharing Controls

Spots are private by default, but some features let you share selected spots with other users or groups or mark a spot public. Once you intentionally share or publish a spot, other people may be able to view the details you included for that spot.

You should only share content with people you trust and only include material you are comfortable disclosing for that purpose.

7. Location And Safety Disclaimer

Location records, map displays, and navigation links may be incomplete or inaccurate. Pean is a memory and organization tool, not a safety, rescue, surveying, or emergency-navigation service.

You are responsible for your own outdoor decisions, route planning, legal access to land or water, and personal safety.

8. Third-Party Services

Pean may rely on third-party services such as Sign in with Apple, web browsers, device notification systems, cloud storage, or map links. Those services are governed by their own terms and policies.

9. Suspension And Termination

We may suspend or limit access if reasonably necessary to protect the service, investigate abuse, comply with law, or enforce these Terms.

You may stop using Pean at any time. Some data may remain subject to our retention obligations described in the Privacy Policy.

10. Disclaimers And Liability

Pean is provided on an as-available basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Pean will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from use of the service.

11. Changes And Contact

We may update these Terms from time to time. Continued use of Pean after an update means you accept the revised Terms to the extent permitted by law.
